Re-ss timeline. How to get a disability and what documents are needed for its registration

Content

Having reached retirement age, a person accumulates diseases that do not make it possible to fully serve their needs and worsen the quality of life. Reliable help to the pensioner will be disability payments, as well as benefits due to people in this position. Since it is not an easy task to issue a disability to a pensioner, you should act wisely in order to avoid disappointments and wasted time.

What is disability

Disability or limitation of human activity caused by physical, sensory, mental pathologies of a permanent or temporary nature is called disability. Nuances:

  • The term covers the physical, legal and social aspects.
  • Recognition of a person as a disabled person automatically gives him the right to receive benefits, additional financial support from the state.
  • Benefits are needed, because the life of a disabled person is not always easy - in addition to the reaction of healthy people to disabled people, a number of domestic inconveniences remain that reduce the standard of living and restrict movement and access to social infrastructure facilities.

Registration of disability for pensioners

Obtaining the status of a disabled person and applying for it legally is not easy - it will take some effort. The key condition for obtaining disability is the presence of a disease that prevents the patient from working and fully serving himself. There are regulations governing the conditions under which a person can claim social status. This is Decree of the Government of the Russian Federation of 2006 under number 95 "On the procedure and conditions for recognizing a person as disabled." At the same time, the decision to assign the status is made by experts on the basis of data on the patient's state of health.

Retirees are more likely to suffer from diseases that limit social opportunities. Many diseases worsen with age and become the cause of complications. For example, diabetes the second type can lead to the development of ulcers on the legs, resulting from infection of any wound or callus. Often a "diabetic foot" in the presence of complications becomes an indication for amputation.

What makes a disability

Depending on the assigned disability group, a pensioner is entitled to a number of benefits and payments. The state budget provides for the following types of support:

  • Monthly cash payment (UDV) is assigned to disabled people of groups 1, 2 and 3 on the basis of an application and a document confirming the benefit.
  • UDV includes a range of social services - free medicines (by prescription), a voucher for sanatorium treatment, travel by rail to the place of treatment. These services can be issued in the form of monetary compensation in the amount established by the Government.
  • Additional social security (DEMO) - a monthly material allowance, is assigned to certain categories of people, among them there are people with disabilities.
  • FSD (federal surcharge) - is accrued only to those pensioners whose income does not exceed the subsistence level (each region has its own).

In addition to increased pay, disability for pensioners is an opportunity to receive some privileges over healthy members of society. List of benefits for disabled people (selection for pensioners):

  • exemption from tax on a car equipped for driving a disabled person, or received through social security authorities (with a capacity of up to 100 hp);
  • 50% discount on the purchase of prescription drugs;
  • a single social travel card for travel in public transport, which must be presented along with a passport and a certificate of a disabled person;
  • free or preferential qualified medical care (outpatient or inpatient);
  • within the framework of an individual rehabilitation program, the right to sanatorium treatment at a reduced price is granted;
  • full provision of prostheses and other means of rehabilitation;
  • a disabled person has the right to a 50% discount on utility bills, fuel required for heating a private house;
  • patients with severe forms of illness can improve their living conditions by taking advantage of the right to receive additional space (a separate room);
  • the right to receive a land allotment for the construction of housing and horticultural work in the first place.

Where to begin

The procedure for obtaining disability is the same for all categories of citizens - employed, pensioners or minors. It is necessary to pay a visit to the local therapist - he will give a referral for an examination. The patient receives a form or “bypass sheet”, where narrow specialists record all the pathologies they have found. Data from laboratory and instrumental studies are entered on the same sheet.

It is important to remember that the results of the analyzes are considered relevant for no more than 14 days (sometimes a month), after which a second study is required. Often given:

  • examination by a neurologist;
  • eye examination by an ophthalmologist;
  • surgeon consultation;
  • examination by a urologist or gynecologist;
  • organ x-ray chest;
  • Ultrasound of the pelvic organs, genitourinary system;
  • blood tests (general, formula, for sugar), urine.

After a complete examination (sometimes in a hospital), the patient is sent to the therapist, who prepares a document for submission to the medical and social examination (MSE) - the so-called "message sheet". An important task of the attending physician is to draw up a summary, which indicates the main diagnosis, research results, the means necessary for the rehabilitation of the patient (wheelchair, hearing aid, prostheses, orthopedic devices, etc.). This document is certified:

  1. signatures of at least three doctors;
  2. the seal of the therapist;
  3. clinic stamp.

Sometimes the therapist sees no reason to file a case with the ITU, then the pensioner has the right to submit documents on his own. To do this, you must receive the doctor's refusal in writing and attach it to the conclusion sheet. After submitting the documents, a day is set for the medical examination, on the basis of which you can issue a certificate of a disabled person. Sometimes you have to wait for your turn for months, although according to the rules, a medical examination should be carried out within a week.

What documents are needed to apply for a disability?

To obtain a certificate of a disabled person, you need to collect an impressive package of papers. You will need the following documents to apply for disability:

  • mailing list to the ITU with the conclusion of a specialist and the seal of the medical institution (form 088 / y-06) - original and copy;
  • medical card, results of early examinations, tests, x-rays, etc.;
  • pensioner's certificate;
  • work book - the original and a copy certified by a notary;
  • if there is an occupational disease or an industrial injury received at the enterprise - an act in the form H1.

Appeal to the medical and sanitary examination

To undergo a medical and social examination, you must contact the ITU bureau at the place of residence (stay). The examination is carried out at home if the patient cannot come personally, in a hospital, and even in absentia. The procedure for registering disability due to illness to a pensioner provides for the possibility of submitting documents to the ITU only partially. Missing papers can be attached to the case until 10 days after the application is written. Further, the patient within 5 days receives an invitation for a certain day to undergo an examination, indicating the number of the office.

How to write a disability application

It is important to fill out the application correctly in order to reduce the time for consideration of documents. To submit it, you need to download the template from the official ITU website or take a paper form from the regional office. The template has a "header" - you need to enter there:

  • surname, name, patronymic (genitive case - “whom?”);
  • Full name of the representative (if necessary);
  • SNILS;
  • passport data;
  • address and contact phone number.

Below it is necessary to mark the item (put a tick in it) - "I ask you to conduct a medical and social examination in order to establish a disability group." Next, mark (underline) a convenient form for receiving an invitation to a commission - by mail or by phone. Fill out the form below - put down the date of writing the application, your signature. All other sections are filled in by the specialist accepting the application.

An application for an examination can be submitted electronically on the gosuslugi.ru website. To do this, you need to register to create a personal account. Then select the appropriate menu "Conducting a medical and social examination to establish disability" and fill out an application. The stages of processing the application can be tracked through your account. First, the patient is informed that his application has been accepted and what documents need to be submitted, then - about the date of the commission.

How to pass the ITU

On the appointed day and time, the patient must come to the Bureau, taking with him a passport, shoe covers and a diaper. There must be at least four doctors in the office to conduct the examination. Specialists will study the medical history, research results, the conclusion of the doctor from the clinic or hospital who gave the referral, the patient's questionnaire. After the inspection, the decision to assign the status of a disabled person is made by voting. In addition, specialists are guided by clause 5 of the Decree of the Government of the Russian Federation, which lists the conditions for obtaining a disability:

  • persistent violation of body functions of a permanent or long-term nature, which are caused by a disease, injury;
  • restriction in self-service (full or partial), inability to move on their own, lack of communication, orientation, control over behavior, training, disability;
  • the need for recovery and adaptation in society, social protection.

In the presence of two or three of the above conditions, a citizen has the right to receive a disability. Sometimes specialists suggest that the patient undergo an additional examination if additional information about the patient's health is required to make a decision. The commission decides on the group (1, 2 or 3), on which the term for assigning the status depends:

  • for the first group - 2 years;
  • for the second and third - 1 year.

The period of re-examination is not established (disability is assigned for life) in case of pathology from the "List of diseases" introduced by the Decree of the Government of the Russian Federation of 2008. Among them are malignant neoplasms with relapses after radical treatment, the serious condition of palliative patients, complete blindness or deafness, the absence of organs or limbs, etc. If the patient is recognized as disabled, he is issued a certificate of the established form and a rehabilitation program.

Contacting the PF

An application for the accrual of a disability pension must be submitted to the territorial branch of the pension fund - at the place of registration or residence (registration). You can write an application at the MFC (multifunctional center). In this case, it is advisable to contact the same branch of the Pension Fund in which the pensioner has already issued social benefits or a pension for seniority.

When applying to the Pension Fund or the MFC, the following documents are required:

  • passport or other identity document - original and photocopy;
  • work book (if it is not available, employment contracts, extracts from orders on appointment to a position, statements of accrual wages) certified by a notary;
  • extract from the ITU act on the recognition of a citizen as a disabled person;
  • statement.

It is worth considering that a person who has the right to several types of pensions (for old age, disability) is assigned only one. State support for a disabled person is not allowed for a citizen who already receives an old-age pension. At the same time, he has the right to issue additional cash payments (EDV, DEMO) and benefits. All accruals will be made to the main account where the pension is received.

How to apply for disability to a bedridden sick pensioner

For people who cannot move independently or with an assistant, a different procedure for obtaining status is provided. The patient's representative (relative or person with a notarized power of attorney) should contact the general practitioner or attending physician for a referral for examinations. Specialists and laboratory assistants are invited to the house for examination and analysis. To implement the procedure, you must contact the head of the department of the clinic. To facilitate the process, the patient may be offered to go to the hospital.

After completing the examination, receiving the results of the tests, the therapist must draw up a conclusion for the ITU. Documents (medical card, passport, work book) are provided by the representative of the patient. He also writes a statement in which there is a column for the full name of the representative. The Medical Examination Bureau sets the date for the home examination. In some cases, the conclusion of the ITU is made in absentia.

How to apply for disability after a stroke to a pensioner

Four out of five stroke survivors qualify for disability status. The consequences of an apoplexy often cause speech disorders, complete or partial paralysis, and other pathologies. Nuances:

  • Not the fact of a stroke, but only its consequences of varying severity - an indication for obtaining the status of a disabled person.
  • Often, a referral to the ITU is prepared during the patient's hospitalization, which simplifies the procedure.
  • It is not difficult to apply for disability after a stroke, but the status requires an annual re-examination.

Denial of disability

Frequency of medical examinations

If the disability is not assigned for life, it must be confirmed, and payments will have to be issued again. For disabled people of the first group, re-examination is appointed every two years, for the rest, the duration of the status is one year. To undergo an examination, the patient goes to the local therapist and, having received a referral, bypasses specialized specialists and takes tests. Then you need to submit documents to the ITU to apply for the status. The order is this:

  • In addition to the conclusion from the clinic, a medical card, a certificate of disability assignment and an individual rehabilitation plan are additionally provided.
  • During the re-examination, the criteria for assigning the status remain the same, but it is possible to change the group - both up and down.
  • Disability can be removed if the patient's health status has improved to the threshold values of the norm.

Therefore, for a referral to ITU, it is best to contact your doctor. But you can also go, for example, to the chief physician of the medical organization in which you are undergoing treatment.

By Government Decree Russian Federation dated February 20, 2006 No. 95 “On the procedure and conditions for recognizing a person as a disabled person”.

In practice, this means that you still have to contact a medical organization.

If you are denied a referral, ask for a written denial. With this certificate, you have the right to apply to the ITU bureau on your own. In this case, the examination will be assigned to you by the employees of the ITU bureau, and based on its results, they will determine whether there is a need for a medical and social examination.

After you receive a referral, you will be recorded for a medical and social examination at the ITU bureau.

"> additional documents.

An application for a medical and social examination may be considered up to one month from the date of submission of the application.

5. Which ITU office should I contact?

Medical and social examination is carried out in the ITU office at the place of residence. In some cases, ITU may be conducted:

  • at the ITU Main Bureau - in case of appeal against the decision of the bureau, as well as by direction of the bureau in cases requiring special types of examination;
  • in the Federal Bureau of ITU - in case of appeal against the decision of the Main Bureau of the ITU, as well as in the direction of the Main Bureau of the ITU in cases requiring particularly complex special types of survey;
  • at home - if a citizen cannot come to the bureau (ITU Main Bureau, ITU Federal Bureau) for health reasons, which is confirmed by the conclusion of a medical organization, or in a hospital where a citizen is being treated, or in absentia by decision of the relevant bureau.

6. How is the examination carried out?

During the examination, the specialists of the bureau will study the documents submitted by you, analyze social, professional, labor, psychological and other data.

In some cases, ITU bureau specialists may prescribe you an additional examination. You can refuse it. In this case, the decision to recognize you as a disabled person or to refuse to recognize you as a disabled person will be made based only on the data you provide. Your refusal will be reflected in the ITU protocol, which is kept during the examination.

Representatives of state non-budgetary funds, the Federal Service for Labor and Employment, as well as specialists of the relevant profile (consultants) may participate in the conduct of a medical and social examination at the invitation of the head of the bureau with the right of an advisory vote. You also have the right to invite any specialist with his consent, he will have an advisory vote.

The decision to recognize a person as disabled or to refuse recognition as a person with a disability is made by a simple majority of votes of the specialists who conducted the medical and social examination, based on a discussion of the results of the medical and social examination.

Based on the results, an act of medical and social examination is drawn up. You have the right to request copies of both the act and the protocol.

In addition, after the medical and social examination, the specialists of the bureau will prepare for you an individual rehabilitation and habilitation program (IPRA).

7. What documents are issued after the examination?

A citizen recognized as disabled is issued:

  • a certificate confirming the fact of the establishment of disability, indicating the group of disability;
  • individual program of rehabilitation or habilitation (IPRA).

A citizen who is not recognized as a disabled person, at his request, is issued a certificate of the results of a medical and social examination.

If it is necessary to make changes (new personal data, technical errors) to the IPRA or, if necessary, clarify the characteristics of previously recommended types of rehabilitation and (or) habilitation measures, it is not necessary to undergo a new medical and social examination. It is enough to write an application to the ITU bureau that issued the document. You will be given a new IPRA.

The date of establishment of disability is the day of receipt by the Bureau of the application for the ITU. Disability is established before the 1st day of the month following the month for which the next MSE (re-examination) is scheduled.

8. How to get re-certified?

Re-examination of disabled people of group I is carried out 1 time in 2 years, disabled people of II and III groups - 1 time per year, and disabled children - 1 time during the period for which the category "child with a disability" is established for the child.

Re-examination can be carried out in advance, but no more than 2 months before the expiration of the established period of disability.

If the disability is established without specifying the re-examination period or if the re-examination must be carried out earlier than the established date, it can be carried out:

  • at the personal request of a disabled person (or his legal or authorized representative);
  • in the direction of a medical organization in connection with a change in the state of health;
  • . More information about the work of the ITU Bureau can be found on the website

In order for a person to have the opportunity to apply for a disability, he must undergo an examination, during which doctors confirm the fact of having a disability.

The examination, or, as it is called, the medical and social examination (MSE), is carried out in the manner strictly defined by law and has a number of nuances. It is for this reason that every interested person should know how the commission of the VTEC (medical labor expert commission) goes.

Why is expertise needed?

The examination is carried out to perform several tasks:

  1. Determining the presence of a disability.
  2. Belonging to a certain group of disability.
  3. The study of links, factors preceding disability.

The examination is regulated by Russian legislation.

Establishment of incapacity for work

Within the framework of Russian legislation, the procedure and conditions under which a person is granted a disability group are clearly regulated. Those persons who are faced with the design of this procedure for the first time have to face many unpleasant nuances.

You can count on receiving a group only on the following facts:

  1. Violation of the state of health due to a persistent disorder of the functionality of his body. For example, the reason for getting a group can be injuries, illnesses.
  2. Obtaining a disability is necessary in order to formalize social income for a citizen who is not able to carry out labor activities.
  3. Limited vitality. For example, partial or complete loss of the ability to serve themselves independently, exercise control over their actions, behavior, communication.
Attention! Obtaining a disability is possible only if a citizen has at least two of the above signs. Recognition of a person as a disabled person is possible only within the framework of the ITU. Download for viewing and printing:

Re-examination of disability

According to the norms of Russian legislation, disability can be given for a limited period and on an indefinite basis. Then the citizen has a need to regularly undergo an examination.

Attention! In April 2018, the procedure for passing the ITU was changed in order to confirm permanent disability. Now it can be installed after the 1st survey without the need for re-applying. Moreover, this can be carried out even in absentia and in relation to persons under 18 years of age.

If we consider the procedure for passing a medical examination in order to confirm a disability group, then there will be no differences in it from a regular examination, with the exception of time.

The frequency of passing the re-inspection of VTEC:

  1. 2-3 disability group - 1 time per year.
  2. 1 group - every six months.

In addition, new analyzes, the results of repeated examinations, and a conclusion issued as a result of the previous examination of the VTEK should be attached to the package of documents.

Definition of disability group

During the medical examination, the members of the commission establish the possibility of establishing one of the disability groups:

  1. . This means that the person really has a health condition disorder, which means that it is difficult for him to perform his basic functional responsibilities meet the eligibility requirements.
    The presence of this disability group indicates that a person cannot continue to perform his labor duties due to the intensity, volume and severity of such activities.
  2. means that a person has deviations in the state of health that do not affect his ability to work, but taking into account the use of auxiliary means.
  3. can be assigned only to those citizens who have confirmed a complete disability, which means they cannot work.
Attention! Obtaining one of these groups is possible only during the survey in strict accordance with the norms of the law.

Instructions for passing the ITU

In order to obtain a disability, the person concerned must go through a series of mandatory steps.

Getting directions

To get a referral to the ITU, a citizen must contact his or her doctor. At the reception, you must inform about your desire to apply for disability.

The attending physician records all the data in the patient's medical book, issues a referral for an examination. After that, the person is sent for a hospital examination, during which it is necessary to tell about all their illnesses and injuries.

All information is recorded in the card, which also includes data obtained as a result of inpatient treatment. In turn, a citizen can be referred to a hospital only after a long outpatient treatment. In the absence of such a person may be refused even in the direction of the examination.

Drawing up an application for an examination

The application is drawn up by the applicant personally, entrusted to the representative. This document states:

  1. The name of the medical institution.
  2. Information about the applicant.
  3. Request for examination, purpose.
  4. Date of application.

The recipient of the document must affix his signature, which is proof of acceptance of the application.

Documents for the medical and social examination are drawn up in the clinic at the place of residence of the applicant. Responsibility for the preparation of documents is assigned to the chairman of the medical commission.

Receiving an invitation from the ITU Bureau

After receiving an application for a medical and social examination, a citizen must wait until an invitation is received.

Notification of this can be made both in writing and in electronic form, in the latter case, the invitation is published on a special Internet portal.

Required documents

It is better to prepare all the necessary documents even before receiving an invitation to undergo an examination. Only in this case, a citizen can be sure that he has collected all the necessary papers:

  1. Passport of the subject.
  2. Referral for a medical and social examination.
  3. Medical documents that reflect the state of health of the patient.
Important! In the event that the applicant does not have any paper left when submitting documents, it will need to be delivered within 10 days.

Carrying out an assessment of the state of the body

The study of the patient's health status is carried out at the place of his residence, or, if there is an appropriate application, at home. In addition, the commission has the right to conduct an examination in a hospital in absentia.

During the ITU, the main task of the present specialists is to conduct an examination of the patient, study all the documents provided and decide on the need to grant him the status of a disabled person, a disability group.

Since May 2019, a medical and social expert study has also been carried out in a medical organization at the place of treatment of a citizen, in a correctional institution and in absentia - subject to the decision of the relevant ITU bureau.

Issuance of an ITU act

Within 30 days from the date of registration of the examination, the decision of the VTEK commission is issued to the patient.

All documents issued as a result of the examination must be entered in the personal file of the person. He can receive copies of these papers, upon submission of the relevant application.

Since May 2019, electronic document management has been introduced.

She will determine whether there is evidence to provide a person not only with the status of a disabled person, but also with state benefits to improve his standard of living.

This examination is a rather serious procedure. And you need to know in advance what documents are needed to pass the MSEC when applying for disability in 2020.

Since it is the package of papers that plays a big role in making a decision.

Important information

Registration of disability in Russia provides for a number of procedures.

Therefore, anyone who wants to receive this status should be prepared for the fact that the entire operation will need to be devoted to a long period of time.

Plus, it is important not to set a disability group for yourself. There is no concept of what criteria are provided by doctors for determining the group.

You can only understand the approximate indicator. And often the attending physician is mistaken and assigns the wrong group to the person, and after passing the commission examination, the disabled person may not agree with the category assigned to him.

In this case, he can challenge the decision of the commission and go through the procedure again. Since this is his right and during the examination he must defend his confirmation of disability.

What it is

MSEC is a medical and social expert commission. The concept itself involves the passage of an examination and peer review.

This examination takes place in cases of registration of people with disabilities.

Since, in addition to the conclusion of the attending physician, it is necessary to establish an expert opinion about the disease, injury or injury of a person.

The committee usually consists of professors and attending physicians. And the examination itself is carried out in medical centers specially equipped for this.

They receive a license from the state to conduct commissions and therefore only they can get the conclusion of the MSEC and be registered as a disabled person of any of the groups.

List of diseases when contacting the commission

There are quite a lot of diseases and disorders, in accordance with which experts can decide on the assignment of the status of a disabled person and the distribution of a person into one of three groups.

So, all that are used to grant disability can be divided into the following groups:

  • violations motor functions organism;
  • metabolic diseases of the blood and the work of the blood flow;
  • disorders in the systems of the respiratory and digestive organs;
  • diseases associated with problems in the metabolic processes in the body;
  • the functions of the senses - vision, hearing, smell and touch are malfunctioning;
  • mental health problems.

All these diseases can be expressed singly or combined in one person. So, the psyche may be disturbed and there may be no possibility of movement.

What regulations govern

The basis of the regulatory framework in this regard in Russia is “On the Social Protection of Disabled Persons in the Russian Federation”.

In this document, in addition to the standard set of provisions on benefits for the disabled and the establishment of disability groups, the concept of the examination itself is also proposed.

For this concept, a separate chapter is allocated - the second. It has only two and, which are responsible for determining the medical and social expertise and for establishing institutions that can conduct such commissions.

Approved by the Administrative Regulations. It is in accordance with this document that a commission is being held to grant disability to citizens of the country.

The algorithm for verifying a person who claims to be a disability group is described in “On the Fundamentals of Protecting the Health of Citizens in the Russian Federation”.

There are also a number of documents that describe the rules for claiming disability. Thus, the main among them is the resolution “Rules for recognizing a person as disabled”.

They are followed by all medical institutions that are authorized to conduct expert commissions in this area.

Documentation Features

When passing a medical and social examination, a mandatory step is to provide documents.

They must confirm the right of a person to receive a disability group. It should be understood that in this case the package of papers must be very large.

It is appropriate to use here:

The conclusions of the attending physician Which were made during the observation of the disease, since it was this doctor who first had to discover the disease or disorder
